This text explains the scope of the consent box you tick when sending the contact or treatment forms after reading the Privacy Notice, and of the consent forms you may sign at the clinic.
1. What is explicit consent?
Under KVKK Art. 3, explicit consent is consent relating to a specific subject, based on information and freely given. Because health and sexual life data are special categories (Art. 6), your explicit consent is required to process such data via a form before examination. Consent is never imposed as a condition of service.
2. Consent to processing of health data
“I have read the Privacy Notice. I explicitly consent to the processing by Assoc. Prof. Muhsin Balaban, MD — Androfert Men’s Health Clinic of the complaint and health information I write in the message field and of my online test answers, for the purpose of appointment planning and the physician’s preliminary assessment; to their sharing with the clinic team and physician for that purpose; and to their storage for the period stated in the Privacy Notice.”
Scope: only the health information you voluntarily share via form, e-mail or WhatsApp. Excluded: medical records created after examination, processed under Art. 6/3 (medical confidentiality) without consent.
3. Transfers abroad (WhatsApp and analytics)
“I explicitly consent under KVKK Art. 9 to the transfer of my message content and phone number to Meta Platforms’ servers abroad if I choose to write on WhatsApp, and of my visit data to Google and Meta servers if I click “Accept” in the cookie bar.”
WhatsApp is end-to-end encrypted, but its infrastructure is located abroad. You may prefer to share health information by phone or at the clinic instead.
4. Commercial electronic messages (optional)
“Under the Turkish Law No. 6563 on the Regulation of Electronic Commerce, I agree to receive SMS, e-mail and WhatsApp messages about clinic services, informational articles and appointment reminders. I know that I can withdraw this consent at any time via the IYS system (iys.org.tr) or the opt-out link in the message.”
Messages relating to your existing request, such as appointment confirmations and reminders, do not require consent. No messages containing health-service advertising are sent.
5. Visual content (at the clinic)
Photographs or videos for medical records and their anonymous use in scientific publications or education are consented to separately in writing at the clinic, using the Visual Content Recording and Processing Consent Form annexed to the Regulation on Promotion and Information Activities in Health Services. No before/after patient images are published on this site.
6. Withdrawal
You may withdraw consent at any time by e-mail to info@drmuhsinbalaban.com or with the Data Subject Request Form. Withdrawal takes effect for the future; records subject to statutory retention are kept with restricted access until the period expires.
7. If you do not consent
You may leave the health-related field of the form empty and request a call-back with your name and phone only, or call us directly. Examination and treatment do not depend on this consent.
